Completion note: only one category of fields remains unfilled in this document — those that depend on a real-world event that has not yet occurred (IPDCP acknowledgment number since the declaration has not yet been sent, OAPI trademark filing status), and nothing else. Everything that could be inferred from discussions with the project owner has been filled in.

2. Publication director

The publication director is KOUASSI N. Emmanuel, in his capacity as Manager of BAHINIBA.

3. Hosting

The SANZA application and website are hosted by the following providers (distinct from the host of the corporate site bahiniba.com):

  • Application hosting (frontend and API): Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, United States. Website: vercel.com
  • Data hosting (database and storage): Supabase Pte. Ltd., 65 Chulia Street #38-02/03, OCBC Centre, Singapore 049513, Singapore (the contracting entity for cloud services under the terms of service published at supabase.com/terms — not to be confused with a possibly separate US entity of the same group, which is not the one used here). Website: supabase.com
  • Data hosting region: Europe, Paris (eu-west-3) — confirmed by a real latency test from Togo and Côte d'Ivoire, the best result among available Supabase regions (160 ms, ahead of Zurich, London, Ireland and Frankfurt).

4. Intellectual property

All elements making up the SANZA website and application (name, logo, texts, interfaces, code, databases, graphic elements) are the property of BAHINIBA and are protected by intellectual property law, in particular the Bangui Agreement governing the African Intellectual Property Organization (OAPI). The SANZA trademark is owned by BAHINIBA ([[ TO COMPLETE: OAPI filing status — "filing in progress", registration number, or not yet initiated. No information on this point has been provided to date; to verify directly with BAHINIBA before publication. ]]).

Any reproduction, representation or exploitation, in whole or in part, without BAHINIBA's prior written authorization is prohibited and would constitute infringement.

Each client company remains the sole owner of the data it enters into the application (invoices, customers, accounting entries). See the Privacy Policy and the General Terms for details.

5. Personal data and data protection correspondent

Data controller: the controller for the personal data described in the Privacy Policy is BAHINIBA, except for data that client companies enter into SANZA about third parties (their customers, suppliers, employees), for which BAHINIBA acts as a processor within the meaning of article 4 of Togolese Law no. 2019-014 of 29 October 2019.

Data protection correspondent: in accordance with articles 75 to 78 of Law no. 2019-014, BAHINIBA has appointed a data protection correspondent:

Operating regime in other countries where SANZA is offered. BAHINIBA has no stable establishment outside Togo. In each other country where SANZA is activated, BAHINIBA applies a policy of substantive compliance without a formal prior declaration to the local authority, until the opening of a local legal entity or reaching a threshold of 50 active clients in that country — full detail in section 2 and the technical annex of the Privacy Policy. The competent authority and applicable legal reference, country by country, are kept up to date there.

6. Governing law

This legal notice is governed by Togolese law. Any dispute relating to its interpretation or performance falls under the jurisdiction of the competent courts of Lomé.
